Terms of Use

These Terms of Use ("Terms") govern your use of the Beautii mobile application ("Beautii," "the app," "we," or "our"). By downloading, installing, or using Beautii, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. License

Beautii grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on any Apple device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Subscriptions and Payments

Subscription plans

Beautii offers the following auto-renewable subscription plans:

• Weekly: $5.99 per week
• Annual: $39.99 per year (includes a 3-day free trial)

Payment and renewal

• Payment will be charged to your Apple ID account at the confirmation of purchase.
• Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase.

Free trials

If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription. Free trial eligibility is determined by Apple and may be limited to one trial per Apple ID.

Price changes

Prices are subject to change. If we change subscription pricing, we will notify you in advance in accordance with Apple's policies. Continued use after a price change takes effect constitutes acceptance of the new price.

3. Description of Service

Beautii provides virtual makeup try-on and beauty product scanning features:

• Virtual try-on: Allows you to see how makeup looks may appear on your face using image processing technology. Results are visual approximations and may not perfectly reflect real-world appearance.
• Product scanning: Allows you to scan beauty products to view ingredient analysis and a Beautii Score. This information is for general informational purposes only.

Not medical or professional advice

Beautii is not a medical device and does not provide medical, dermatological, or professional beauty advice. Ingredient analysis, safety ratings, and Beautii Scores are generated for informational purposes only and should not be relied upon as a substitute for professional advice. Always consult a qualified professional for skin concerns, allergies, or health-related questions.

Accuracy of results

Virtual try-on results are approximations generated by image processing technology. Actual product appearance may differ. Product scan results are based on image recognition and may not always be accurate. We do not guarantee the accuracy, completeness, or reliability of any results provided by the app.

5. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Reverse engineer, decompile, or disassemble the app
• Attempt to gain unauthorized access to any part of the app or its systems
• Use the app to upload or transmit harmful, offensive, or inappropriate content
• Redistribute, sublicense, or resell the app or any content within it
• Use the app in a manner that could damage, disable, or impair the service

6. Intellectual Property

All content, features, functionality, design elements, trademarks, and branding within Beautii are owned by Beautii and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the app without express written permission.

Photos you take and try-on results you generate are yours. By using the app, you grant Beautii no rights over your personal photos or generated results.

7. Privacy

Your use of Beautii is also governed by our Privacy Policy, which describes how we handle your information. By using the app, you consent to the practices described in the Privacy Policy.

8. Third-Party Services

Beautii uses third-party services to provide its functionality, including Google's Gemini API for image processing and RevenueCat for subscription management. These services are governed by their own terms and privacy policies. We are not responsible for the practices of third-party services.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Beautii and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of or in connection with your use of the app.

In no event shall our total liability exceed the amount you have paid for the app or subscription in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

Beautii is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

11. Indemnification

You agree to indemnify and hold harmless Beautii from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the app or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the app is revoked.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of Beautii after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Romania.

15. Apple-Specific Terms

These Terms are between you and Beautii, not with Apple Inc. ("Apple"). Beautii, not Apple, is solely responsible for the app and its content. Your use of the app must comply with the App Store Terms of Service. Apple has no obligation to furnish any maintenance or support services with respect to the app. Apple is not responsible for addressing any claims relating to the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims by you or any third party relating to the app or your use of it, including product liability, compliance with legal requirements, or intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
